Financial Crisis Response Team
Rapid and unprecedented changes in global financial markets are affecting businesses around the world. The sub-prime mortgage crisis that began in the USA over a year ago has drastically affected the global credit system, with severe impacts on the stability of financial institutions, financial services providers and on global and domestic economic activity. Several economies are already in or on the brink of recession, with others likely to follow.
This is a period of economic uncertainty and concern for many. Yet for some this period will present once in a lifetime investment opportunities. While individuals and businesses will have varying views on economics during this historic period, it is certain that the sources and costs of funding are changing, and government regulation is intensifying.
As shares and property used as security are significantly revalued, borrowers are having to refinance. As recession looms in Australia and New Zealand, so too does the threat of increased redundancies. Numerous high profile companies are already in reconstruction mode, particularly in financial services, and we can reasonably expect this trend to continue.
To help our clients deal with these issues, DLA Phillips Fox has established a multi-disciplinary working group that is focused on supporting clients in the following areas:
- Refinancing of existing sources of funding.
- Restructuring of capital structures and asset classes.
- Asset sales and purchases.
- Complex securities.
- Clearing and settlement matters.
- Guidance within the changing regulatory environment.
- Risk management, enforcement and litigation matters.
- Reconstruction and insolvency.
- Workplace relations and employment matters.
- Restructuring property deals and joint ventures.
Our Financial Crisis Response Team has substantial experience in each of these areas, supported by broad regulatory and financing expertise. Through our alliance with DLA Piper, we also have the skills and knowledge of specific overseas markets to take care of your legal needs anywhere in the world.
